GARAGE RAW S.r.l.<\/strong>, (VAT no.: 03734090362) (hereinafter \u201cGARAGE RAW\u201d), represented by its pro tempore legal representative, with its registered office in Bologna, Via Galliera, 8, as Data Controller pursuant to Articles 4(7) and 24 of EU Regulation no. 2016\/679 (GDPR), provides the following cookie policy (\u201cPolicy\u201d) applicable exclusively to this website<\/span> www.garageraw.com<\/span><\/a> (the \u201cWebsite\u201d).<\/span><\/p>\n

    1. <\/b>LEGAL FRAMEWORK<\/h2>\n\n

    2. COOKIE E ALTRI STRUMENTI DI TRACCIAMENTO: DEFINIZIONE E CLASSIFICAZIONE.<\/h2>\n\n

    2.1.<\/strong> \u201cCookies\u201d are, in general, text strings that a website (the \u201cpublisher\u201d or \u201cfirst-party\u201d website) visited by the user, or a different website (\u201cthird-party\u201d website), places and stores\u2014directly (in the case of a first-party website) or indirectly (via the first-party website in the case of a third-party website)\u2014on a terminal device available to the user. The Italian Data Protection Authority (Garante Privacy) has specified that the information encoded in cookies may include both personal data as per Article 4(1) of the GDPR (e.g., IP address, username, email address, unique identifier) and non-personal data as per Article 3(1) of EU Regulation no. 1807\/2018 (e.g., language, type of device used).<\/span><\/p>\n

    In addition to cookies, there are \u201cother tracking tools\u201d that can also be used. These can be classified as \u201cactive\u201d (which have characteristics similar to cookies) and \u201cpassive\u201d (e.g., fingerprinting).<\/span><\/p>\n

    2.2.<\/strong> Beyond their intrinsic characteristics, cookies (and other tracking tools) can differ in temporal scope (and thus be classified as \u201csession\u201d or \u201cpersistent,\u201d depending on their duration), subjective scope (depending on whether the publisher operates independently or on behalf of a \u201cthird party\u201d), and most notably, in their purpose of processing. Based on the latter, cookies can be divided into two main categories:<\/span><\/p>\n

    • \u201cTechnical\u201d cookies<\/b>, used solely for the purpose of \u201ctransmitting a communication over an electronic communications network, or as strictly necessary to the provider of an information society service explicitly requested by the subscriber or user to provide that service\u201d (Article 122(1) of the Privacy Code).<\/span>
      <\/span>Regarding this, the Italian Data Protection Authority highlighted in Decision no. 231 of 10.6.2021 (consistent with the previous 2014 Decision) that \u201canalytics cookies\u201d can be considered \u201ctechnical\u201d cookies (and thus used without the user\u2019s prior consent) if specific conditions are met to prevent the direct identification of the data subject (single out).<\/span><\/li>\n<\/ul>\n

      \u201cProfiling\u201d\/\u201cmarketing\u201d cookies<\/b> (non-technical cookies), used to associate specific actions or recurring behavioral patterns (patterns) of identified or identifiable subjects with the use of the offered features. These aim to group different profiles into homogeneous clusters of varying sizes, enabling the Data Controller to personalize the service beyond what is strictly necessary and to send targeted advertisements (aligned with the user\u2019s preferences during web browsing).<\/span>
